From the Preface: "The ability to identify the crimes of war, crimes against humanity, and the crimes against the peace depends upon the existence of rules or laws of war. Nuremberg found these rules in congresses like those at Geneva and the Hague, and in the Paris Pact of 1928. Were these really rules of war? Nations could evade them by the simple strategy of refusing to sign, and even signator nations were excused from their prior commitments in any war with non-signators. The reasons for the general failure of all congressional prohibitions lie in three military doctrines: military necessity, the right of reprisal, and the obligation of solidiers to obey superior orders. These doctirnes were to support the basic premise that sovereign nations had the right to wage war in their national self interest. There has been an historic dilemma. On the one hand, nations did not want to lose their sovereignty, yet, on the other hand they did not wish to appear as brutes. There must be some acts of war which are utterly forbidden. The contrast between what the congresses prohibit and the military manuals allow sets the as yet unresolved conflicts."
